By accessing or using the MyKeja platform ("Platform"), including our website, mobile applications, and all related services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must not use the Platform.

These Terms constitute a legally binding agreement between you ("User") and MyKeja ("we", "us", "our"). We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

You must be at least 18 years old and legally capable of entering into binding contracts under Kenyan law to use this Platform.

2. User Accounts & Responsibilities

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Each user may only maintain one account. Creating multiple accounts, impersonating others, or providing false information is strictly prohibited and may result in immediate account termination.

You agree to immediately notify MyKeja of any unauthorized use of your account or any other breach of security. MyKeja is not liable for any loss arising from your failure to protect your account credentials.

3. Property Listings & Host Obligations

Hosts must provide truthful, accurate, and non-misleading information about their properties, including but not limited to: location, amenities, pricing, availability, and condition. All photographs must accurately represent the current state of the property.

Hosts are solely responsible for compliance with all applicable Kenyan laws, including landlord-tenant regulations, building codes, safety standards, and tax obligations. MyKeja does not verify legal compliance of listed properties.

Hosts must not engage in discriminatory practices in tenant selection. Pricing must be transparent — all fees, deposits, and charges must be disclosed upfront on the listing. Hidden fees are strictly prohibited.

MyKeja reserves the right to remove any listing that violates these Terms, contains misleading information, or receives repeated complaints from tenants.

4. Tenant Obligations

Tenants must engage honestly with the Platform. This includes providing accurate personal information, honoring viewing appointments, and communicating truthfully with hosts.

Tenants acknowledge that all property information on the Platform is provided by hosts. While MyKeja verifies host identities, we do not independently verify every detail of every listing. Tenants should exercise due diligence before entering any rental agreement.

Any attempt to defraud hosts, manipulate reviews, or misuse the messaging system will result in immediate account suspension and potential legal action.

5. Payments, Fees & Transactions

MyKeja may charge service fees for certain features, including but not limited to: premium listings, lease agreement generation, and viewing bookings. All applicable fees will be clearly disclosed before you incur them.

All financial transactions between tenants and hosts are conducted directly between the parties. MyKeja acts solely as a facilitator and is not a party to any rental agreement or financial transaction between users.

Users must not attempt to circumvent the Platform's fee structure or redirect transactions outside the Platform to avoid service fees. Such behavior constitutes a violation of these Terms.

6. Privacy & Data Protection

MyKeja collects and processes personal data in accordance with the Kenya Data Protection Act, 2019. By using the Platform, you consent to the collection, use, and storage of your personal information as described in our Privacy Policy.

We collect information including but not limited to: name, email, phone number, government ID (for verification), property details, and usage data. This information is used to operate the Platform, verify identities, prevent fraud, and improve our services.

Your personal data will not be sold to third parties. We may share limited information with service providers who assist in operating the Platform, subject to confidentiality obligations.

You have the right to access, correct, or request deletion of your personal data. Contact our support team to exercise these rights.

7. Limitation of Liability

MyKeja is a technology platform that connects property hosts with prospective tenants. We are NOT a landlord, property manager, real estate agent, or broker. We do not own, manage, or control any properties listed on the Platform.

To the maximum extent permitted by law, MyKeja shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: (a) your use or inability to use the Platform; (b) any transaction between users; (c) the condition, legality, or suitability of any listed property; (d) the actions or omissions of any user.

MyKeja does not guarantee the accuracy of any property listing, the reliability of any user, or the outcome of any rental transaction. Host verification ("Verified Badge") confirms identity only — not the quality or legality of their properties.

Users assume all risk associated with rental transactions conducted through the Platform. We strongly recommend conducting in-person property inspections before entering any rental agreement.

8. User Content & Intellectual Property

By uploading content (photos, descriptions, reviews) to the Platform, you grant MyKeja a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and promoting the Platform.

You represent that you own or have the right to share any content you upload. Content that infringes on intellectual property rights, contains defamatory material, or violates any law will be removed.

All MyKeja branding, design, code, and original content are the intellectual property of MyKeja and may not be copied, modified, or distributed without prior written consent.

9. Dispute Resolution

In the event of a dispute between users, MyKeja may, at its sole discretion, provide mediation assistance but is under no obligation to do so. MyKeja is not responsible for resolving disputes between hosts and tenants.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any legal proceedings arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

Users agree to first attempt to resolve any dispute through MyKeja's internal support system before pursuing external legal action.

10. Termination & Account Suspension

MyKeja reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable.

You may delete your account at any time through the Platform settings. Upon deletion, your personal data will be removed in accordance with our data retention policies and applicable law.

Sections relating to Limitation of Liability, Intellectual Property, and Dispute Resolution shall survive termination of these Terms.
